TERMS AND CONDITIONS OF AZAFRAN INNOVACION LTD

Please read the following terms and conditions very carefully as your use of the Website is subject to your acceptance of and compliance with the following terms and conditions ("Terms").

By subscribing to or using our Website you agree that you have read, understood and are bound by the Terms, regardless of how you subscribe to or use the Website. If you do not want to be bound by the Terms, you must not subscribe to or use our services. These Terms and the various other policies are binding as per the provisions of the Information Technology (Intermediaries guidelines) Rules, 2011 formulated under the Information Technology Act of 2000. In these Terms, references to "you", "User" shall mean the end user accessing the Website, its contents and using the services offered through the Website, "Service Providers" mean independent third party service providers, and "we", "us" and "our" shall mean Azafran Innovacion Limited (hereinafter referred to as Azafran) and its affiliates.

  • Azafran attempts to be as accurate as possible in the description of its products and services  on its Website. However, Azafran does not warrant that the product description, colour, information or other content of the Website is accurate, complete, current or error-free. The product pictures are indicative and may not match the actual product.

    Azafran reserves the right to correct, change or update information, errors, inaccuracies or omissions at any time (including after an order has been submitted ) without prior notice. Please note that such errors, inaccuracies or omissions may also relate to pricing and availability of the product or services.

    1. PRODUCT USE AND SERVICES

    It is highly recommended that you please read the individual terms and conditions carefully in relation to the products and beauty services and consult a specialist before the use of the same.

    Any recommendation made to you in the Website during the course of your use of the Website is purely for informational purposes and for your convenience only.

    1. GUIDELINES FOR PLACING ORDERS

    Orders can be placed through our Website, by email, post or telephone. In order to avoid communication errors we strongly recommend that orders be placed in writing via our Website, email. We guarantee the accuracy of written orders, however, we accept no responsibility for errors as a result of verbal miscommunication.

    Once we receive an order, it is our endeavor to process it the same day or maximum by the next day. However circumstances impacting dispatch is beyond our control . Any modifications to a processed order shall amount to a new order.

    • International orders will need to be confirmed before the order is processed, payment is charged, and dispatch is made. The order will be held until the customer advises the final confirmation.
    • Due to the volatile nature of the essential oil and cosmetic raw materials market, price commitment is made on the placement of order only. We endeavour to ensure accurate pricing on both our catalogue and Website. We will do our best to notify our customers of discrepancies due to changes in prices.
    • Whilst we do not impose minimum order quantities, ordering items in bulk can result in substantial savings and discounts.
    • If any item is short delivered and has been charged for, Azafran will be happy to cover the cost of freight in resending the goods as soon as possible. Please note items are not backordered and need to be re-ordered at the time they become available.
    • We offer Pick Ups. Please provide minimum one day notice before the time of collection so that your order can be invoiced, picked, packed and ready for pick up at the time of your arrival. Pick Up hours are between 9.00am and00pm.
    4. PRICING AND PAYMENT METHOD

    All orders must be paid for prior to shipping.

    Payments for the products available on the Website may be made in the following ways:

    • Payments can be made by Credit Cards, Debit Cards, Net Banking, Wallets, e-Gift cards, and reward points.
    • Credit card, Debit Card and Net Banking payment options are instant payment options and recommended to ensure faster processing of your order.

    Account details for Direct Deposit are as under:

    Azafran cannot confirm the price of the product until you make the order. Without limiting the generality of Clause on Cancellations, Refunds and Returns below, if a product / service is listed at an incorrect price or with incorrect information due to any technical error, Azafran shall have the right, at its sole discretion, to refuse or cancel any orders placed for that product/ service, unless the product has already been delivered or the service has already been availed by you. In the event that an item is wrongly priced, Azafran may, at its discretion, either contact you for instructions or cancel your order and notify you of such cancellation. Unless the product ordered by you has been delivered and the services are availed, your offer will not be deemed accepted and Azafran will have the right to modify the price of the product/ service and contact you for further instructions using the e-mail address provided by you during the time of registration or placing of order, or cancel the order and notify you of such cancellation. In the event that Azafran accepts your order the same shall be debited to your credit card/ debit card account and duly notified to you by email that the payment has been processed. The payment may be processed prior to Azafran’s dispatch of the product that you have ordered. If we have to cancel the order after we have processed the payment, the said amount will be reversed to your credit / debit card account.

    1. PRICING AND TAXES

    All prices are quoted in Indian Rupees. Prices quoted in our Website include GST.

    For International orders, there might be import duties and taxes applicable to the destination of shipment .

    All prices are quoted ex-works and do not include shipping & transportation costs. Azafran representative will get in contact with you shortly after placing your order to advise the freight charges that apply to your order. Freight charges vary depending on the 3rd party courier and the volume and weight of your order. If you do not need confirmation please type "DON'T NEED CONFIRMATION" in the comments field provided below.

    1. CANCELLATIONS

    In case of cancellation once the shipment has already been dispatched or if it is being returned, we process the refund once the products have been received and verified at our warehouse.

    For payments done through credit/debit cards or net banking ,the refund will be processed to the same account from which the payment was made within 24-48 business hours of us receiving the products back. It may take 2-3 additional business days for the amount to reflect in your account. 

    In addition, we also provide the hassle-free option of refund through Azafran coupons, which can be used during future purchases. Discount vouchers are intended for one-time use only and shall be treated as used even if you cancel the order.
    If you had redeemed loyalty points for an order, the same will be credited back to your account in the case of a cancellation.

    1. RETURNS, REPLACEMENT AND REFUNDS

    Indian Orders:

    Azafran offers its customers an ’Easy return policy’, wherein you can raise a return/exchange request of a product within 7 days of its delivery. We also accept partial returns wherein you can raise a return request for one or all products in you order.

    • Step 1: Contact our Customer Support team via email info@azafranprevie.com within 7 days of receiving the delivery.
    • Step 2: Provide us with your order ID details and your request to return/replace/refund your order. Kindly email an image of the product and the invoice for our reference.
    • Step 3: We will pick up the products within 2-4 business days. We will initiate the refund or replacement process only if the products are received by us in their original packaging with their seals, labels and barcodes intact.

    International Orders:

    Products can only be eligible for returns if the products received by the customer are deemed to have been received in a damaged / defective state or are expired or an incorrect product has been delivered. Such products can only be returned in their original packaging, in an unused and sealed condition. [Opened or used products will not be accepted as returns.]

    If a return is accepted, Azafran will replace or refund the invoiced rupee value for, the damaged / defective / expired / wrong product. In either case, the additional customs amount paid by the customer to receive the product will be reimbursed to the customer in the form of a refund coupon, that can be applied to the customer’s next order with Azafran, subject to the customer providing a copy of the customs receipt.

    Note: If it is a case of replacement, it is subject to the availability of stock. In cases when a replacement may not be available, we will refund you the full amount. Kindly refer to the next question for exclusions to refunds.

    Returns will not be accepted under the following conditions:

    • Product is damaged due to misuse/overuse
    • Returned without original packaging including, price tags, labels, original packing, freebies and other accessories or if original packaging is damaged
    • Serial Number is tampered with.
    • Defective products that are not covered under Seller/Manufacturer’s warranty
    • Product is used or altered
    • If request is initiated after 7 days of order delivery
    • Free product provided by brand

    Categories not eligible for Return:

    • Customized Products (eg: lipsticks, compacts, mascaras, etc) cannot be returned since they are available during select promotions and ordered on demand
    • Personal care appliances cannot be returned due to hygiene issues

    Please note: For certain marketing campaigns or mega sale periods, special return/exchange/refund rules may apply. Information regarding this is visible on the promotion banner. For any clarification, please feel free to contact our customer care.

    Damaged or Defective Product

    Our shipments go through rigorous quality check processes before they leave our warehouse. However in the rare case that your product is damaged during shipment or transit, you can request for a replacement or cancellation and refund.

    If you have received an item in a damaged/defective condition or have been sent a wrong product, you can follow a few simple steps to initiate your return/refund within 7 days of receiving the order:

    • Step 1: Contact our Customer Support team via email info@azafranprevie.com within 7 business days of receiving the order.
    • Step 2: Provide us with your order ID details and your request to return/replace/refund the defective/wrong items in your order. Kindly share an image of the product and the invoice for our reference.
    • Step 3: We will pick up the products within 2-4 business days. We will initiate the refund or replacement process only if the products are received by us in their original packaging with their seals, labels and barcodes intact.

    Note: If it is a case of replacement, it is subject to the availability of stock. In case that a replacement may not be available, we will refund you the full amount.

    Return of an Order

    A return can be created at item level and if you have ordered multiple items, you can initiate a return/replacement/refund for any individual item. However, any product being returned needs to be returned in full including all components as well as any complimentary gifts or products which came along with it.

    In case of a return/replacement/refund, we process the refund once the products have been received and verified at our warehouse.

    1. SHIPPING

    Domestic Shipping - Once our system processes your order, your products are inspected thoroughly to ensure they are in a perfect condition. After they pass through the final round of quality check, they are packed and handed over to our trusted delivery partner. Our delivery partners then bring the package to you at the earliest possibility. In case, they are unable to reach your provided address or at a suitable time, they will contact you to resolve the issue.

    International Shipping – International clients do not pay import duties levied by their government to Azafran. Clients will have to pay the customs duty to the courier provider in order to receive the product.

    1. PACKAGING

    We pride ourselves on the quality of our packaging.

    We package our products in boxes, which are covered in a plastic layer. Each individual product is packaged in bubble wrap and/or any other appropriate packing material while fragile items like bottles are safely secured with additional bubble wrap.

    1. TRACKING OF ORDERS

    Once your order has been dispatched, you will receive an email with the details of the tracking number and the courier company that is processing your order. You can track the status of your package 24 hours after your order is dispatched from our warehouse.

    1. ESTIMATED DELIVERY TIME

    We usually dispatch most orders within 1-4 business days (excluding Sundays and public holidays). Though, we keep 95% of our catalogue in our inventory, certain products may need more time and while we are trying our best to avoid this situation, these products might delay your order. However, in case of international orders, product delivery may get delayed due to reasons attributable to logistics, public holidays, etc. If you are ordering our products from a Mega Sale event, dispatches may be a bit delayed due to increased volumes. We will target to dispatch all orders within 5 days of order date. 

    1. PRODUCT LIABILITY

    The stability and  nature of our products may be altered depending on storage conditions, or when used in combination with other ingredients. This is beyond our control and in case you intend to use the products for commercial use we strongly recommend lab tests prior to commercial runs. Azafran cannot accept any liability in this regard.

    1. INTELLECTUAL PROPERTY RIGHTS

    The name and logo and all related product and service names, design marks and slogans are the trademarks, logos or service marks (hereinafter referred to as "Marks" ) of Azafran. All other Marks provided on the Website are the property of their respective companies. No trademark or service mark license is granted in connection with the materials contained on this Website. Access to this Website does not authorize anyone to use any Marks in any manner. Marks displayed on this Website, whether registered or unregistered, of Azafran or others, are the intellectual property of their respective owners, and Azafran shall not be held liable in any manner whatsoever for any unlawful, unauthorized use of the Marks.

    This Website is provided to you "AS IS". We make no representations regarding the use of or the result of the use/depiction of the Contents on the Website in terms of their correctness, accuracy, reliability, or otherwise.     Azafran is a wholesaler of natural skin care products and natural raw materials. If you intend to re-label our products under your own name/ brand for the purpose of on-selling or retailing, we strongly recommend that you keep up to date with constantly changing labeling and packaging laws. Under no circumstances will Azafran be held liable or responsible for any loss, damages or claims and/or  product recall due to incorrect labeling and/or packaging.

    In case of commercial reuse of the products, all   packaging must be subjected to the conditions that you intend the finished products to endure. In particular, please subject the packaging to the following conditions whilst fully filled:

     

    1. Test the packaging for leaks. All packaging could potentially leak, except those with a physical barrier such as an induction foil
    2. Ensure that the packaging does not leak over time - Upside down or on its side. None of the packaging sold by Azafran is leak tested.

      b.Leakages of gases that will contribute to evaporation is not uncommon in a lot of packaging.

      c. If the capping is to be done with an automatic capper, please test this with the automatic capper, if capping manually, please ensure the trials are carried out with hand capping.

      d. Subject the capped product to a leaking test over the intended logistical conditions, by air, sea or land. Please note that some products may attack the plastic components of the packaging and this might reduce the sealing capability of the packaging over a period of time.
    3. Volumetric requirements
    4. There are a range of different requirements for head space and overfill. (Different customers over-fill their products to different levels, some overfill by 5ml and others by 10%) Further, some closures and crimping machines reduce the overall volumetric properties of some containers. You are encouraged to check the capacity of your intended packaging to ensure that you are satisfying your requirements of the volume you require as well as the legal requirements in the country of sale. Our volumetric labels are intended only as a guide.

      bFilling equipment at times require a certain amount of head space depending on the viscosity of the product. This also varies greatly with the temperature of the product. Please ensure that you test the packaging for appropriate capacity with your filler at the right temperature and using the machines that are intended for production.
    5. Chemical reactions between the packaging and contents

    All packaging must be tested against chemical reactions. Different chemical compounds with varying concentration will have varying effects on the packaging. There is no substitute to testing the packaging against your intended use over time as some concentrations of common chemicals used, attack common plastic used in our packaging. Discoloration of product, rust and distortion of packaging could occur.

    1. Dispensing Closures

    Common failures of dispensing closures are well known.

    a. Oil based ingredients do not usually work well with mist sprays. At times this might not be evident until several weeks have passed. The failure can be manifested by leaking, failure to mist with the spray and dispensing without depressing the actuator. Whilst some of these issues can be overcome with a high density gasket mist spray, some are not easily overcome.

    b. Liquids with particulates (solids) do not mist spray well.

    c. High viscosity liquid with low surface tension such as gels and pastes do not work well with lotion or liquid pumps.

    d. Air bubbles in the fill can cause airless pumps to stop working.

    1. Decorations

    Check the adhesion, registration and repeatability of the decorations required before screen printing. Labels and hot foil do not have the same process capability. Care should be taken to not apply labels over the air hole in airless packaging.

    1. All custom products must be approved prior to production

    All customers must approve custom products and ensure that they either carry out the trials required or assume the risks outlined above if the trials and tests are omitted. Custom products may not be returned.
       

    1. DISCLAIMER WITH RESPECT TO INGREDIENTS

    As the availability of ingredients and raw materials is not always certain whether due to changes in nature or otherwise, Azafran reserves the right to substitute alternate ingredients/raw materials in the manufacture of its products and bases in order to maintain supply to its customers.

    Customers should always refer to the ingredients label as affixed to each product or to specification sheets which are current at the time of supply of the product.

    1. WORKSHOP AND COURSES DISCLAIMER AND BOOKING CANCELLATION POLICY

    Disclaimer
    Azafran will make every effort to ensure that the workshop and the program content will take place as advised. Please note however, Azafran reserves the right to cancel or make changes to any workshop and its content at any time as circumstances dictate. In the event that a workshop is cancelled by Azafran, the registrant will be entitled to a credit or refund to the value of the cost of the workshop only. Azafran will not be financially responsible for consequential losses such as airfares, accommodation and so on. Should a workshop be cancelled, registrants will be notified by email or phone with as much notice as possible. Every effort will be made to provide a workshop of equivalent standard and value at a future date and registrants will be advised of the same.

    Workshop Booking Cancellation Policy:
    Once a workshop booking has been confirmed, all workshop bookings are non-refundable however may be transferred to another date if available, gifted to a nominated person, or a credit to the maximum value of the workshop can be saved to use for purchases of Azafran products and services via the Website, over the phone or within our showroom. Workshop booking cancellations must be made no later than 7-days prior to the scheduled date of the workshop.

    1. PRIVACY POLICY

    Azafran is committed to complying with its legal obligations under the privacy policy and data protection laws of India.

    Lawful basis of processing your Personal Data

    We are permitted to process your Personal Data in compliance with applicable laws and regulations by relying on one or more of the following lawful bases:

    • You have explicitly agreed to us processing your Personal Data for a specific reason
    • The processing is necessary to perform the agreement we have with you or to take steps to enter into an agreement with you
    • The processing is necessary to be in compliance with our Legal Obligations

    Where the processing is based on your consent, you have a right to withdraw your consent at any time. You may withdraw consent by contacting us. Upon receipt of your written request to withdraw your consent, consequences of withdrawal will be communicated to you and, upon your agreement, your request for withdrawal will be processed.

    So that we may to provide better service to our valued customers, we may request personal details such as your name, address, e-mail address, telephone number and so on. Please note that in some circumstances in relation to particular ingredients and raw materials the collection of that information is required by law.

    The personal information that we collect is generally used for record keeping purposes and so that we may properly serve, promote and market our products to you. We do not use your personal information for any purpose other than for the purpose as set out herein below. We do not provide or sell your personal information to third parties.

    We may disclose your Personal Data for the above purposes to other parties including:

    • Other group companies and any subcontractors, agents or service providers who work for us or provide services to us or group companies (including their employees, sub-contractors, service providers, directors and officers)
